1. About these terms

These Terms of Use govern your access to and use of Mana Hub (the platform), including browsing listings, creating a profile, publishing a business, service, product, event or role, and contacting other members.

By using Mana Hub you agree to these terms. If you do not agree, please do not use the platform.

2. Mana Hub is a platform only

Mana Hub provides a directory and discovery platform that lets members publish and find listings. We are not a party to any transaction, agreement, booking, engagement or employment arrangement made between members.

Every business, service, product, event, job and community listing is created, described, priced and supplied by the member who published it. That member is solely responsible for their listing and for anything they sell, supply, deliver or perform.

• We do not sell, resell, supply, deliver, install, perform or fulfil any listed product or service.
• We do not act as an agent, broker, employer, adviser, insurer or guarantor for any member.
• We do not set, collect or hold prices, fees, deposits or payments for member transactions.
• We do not control the quality, safety, legality, licensing, timing or accuracy of any listing.

3. No warranty or guarantee

Mana Hub gives no warranty, guarantee, endorsement or assurance of any kind in relation to any business, service, product, event, role, member or listing on the platform. All listings are made available on an "as is" and "as available" basis.

Any verification badge, review, rating, category, ranking or similar signal shown on Mana Hub is an aid to discovery only. It is not a recommendation, certification, accreditation, or a guarantee of quality, workmanship, licensing, insurance, availability, suitability or outcome.

You choose who to deal with. You are responsible for making your own enquiries and for satisfying yourself about a member and their offering before you buy, book, engage, attend, apply or pay.

4. Your responsibility when dealing with members

Any contract you enter into is between you and the other member, not with Mana Hub. Before transacting, we strongly encourage you to carry out your own due diligence.

• Confirm the identity, trading name, registration and contact details of the other party.
• Check any licence, certification, insurance or qualification that the work requires.
• Agree scope, price, timing, delivery, refunds and cancellation terms in writing before you pay.
• Keep your own records of quotes, invoices, receipts and correspondence.
• Never send money to someone you cannot verify, and treat pressure to pay urgently as a warning sign.

5. Disputes between members

Any dispute, complaint, defect, delay, cancellation, refund, damage, injury or loss arising from a transaction is a matter between the members involved. Mana Hub is not a party to it and has no obligation to investigate, mediate, arbitrate, refund or compensate.

We may, at our sole discretion and without any obligation to do so, remove a listing, suspend an account or pass information to the relevant authorities where we consider it appropriate.

6. Member obligations

If you publish a listing, you are responsible for it and you confirm that you have the right to offer what you list.

• Your listing must be accurate, current, lawful and not misleading or deceptive.
• You must hold every licence, registration, consent, certification and insurance your activity requires.
• You must comply with all applicable New Zealand law, including the Fair Trading Act 1986, the Consumer Guarantees Act 1993 and the Privacy Act 2020, where they apply to you.
• You must not post content that is unlawful, fraudulent, infringing, offensive, unsafe or spam.
• You must honour the commitments you make to other members through the platform.

7. Consumer law

Nothing in these terms is intended to limit or exclude any right or remedy you may have under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, to the extent those rights cannot lawfully be excluded.

Where a consumer guarantee applies to goods or services supplied by a member, that guarantee is owed by that member as the supplier, not by Mana Hub.

8. Limitation of liability

To the maximum extent permitted by law, Mana Hub, its owners, employees and partners are not liable for any loss, damage, cost, expense, injury or claim arising from or connected with a listing, a member, a transaction, or your use of or inability to use the platform. This includes indirect and consequential loss, and loss of profit, data, goodwill or opportunity.

To the maximum extent permitted by law, our total aggregate liability in connection with the platform is limited to the amount you have paid to Mana Hub (if any) in the twelve months before the event giving rise to the claim.

9. Availability and changes

We may change, suspend, limit or discontinue any part of the platform, including any listing or feature, at any time and without notice. We do not guarantee that the platform will be uninterrupted, secure or error free.

We may update these terms from time to time. The version published on this page applies to your use of the platform, and continuing to use Mana Hub after an update means you accept the revised terms.

10. Governing law and contact

These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction.
